Terms of Service

1. Acceptance of Terms

By signing up, creating an account, or interacting with the Vergate infrastructure service ("Service"), you agree to be bound by these Terms of Service. If you are entering into these terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms.

Please read these terms carefully before accessing or using our platform. These rules govern your use of the passive and active scanning utilities provided by Vergate.

2. Scanning Authorization and Liability

Vergate provides scanning tools that perform passive and active checks on target endpoints. By initiating a scan (whether passive inline or active ZAP scans), you declare under penalty of perjury that you are the legal owner of the target domain or have received express written authorization from the owner to perform such security checks.

⚠️ CRITICAL LEGAL NOTICE: UNAUTHORIZED SCANNING

YOU AGREE TO BEAR FULL LIABILITY FOR ALL SCANS INITIATED THROUGH YOUR ACCOUNT. Performing active scans on websites or API endpoints without explicit permission is illegal and constitutes a breach of international computer misuse and anti-hacking laws (including the US Computer Fraud and Abuse Act and the UK Computer Misuse Act).

If you violate this term:

  • Your account will be terminated immediately.
  • You may face direct civil lawsuits or criminal prosecution from the targeted parties.
  • Vergate will fully cooperate with law enforcement agencies and disclose access logs upon legal request.

You agree to indemnify, defend, and hold harmless Vergate Inc., its officers, employees, and suppliers from any third-party claims, lawsuits, damages, or liabilities arising from security tests conducted via your account.

3. Prohibited Use and API Safety

You agree not to use the Service to:

  • Scan targets containing critical life-support, aerospace, or military infrastructure where minor load disruptions could cause physical harm.
  • Conduct DDoS (Distributed Denial of Service) testing or bypass system bandwidth safeguards.
  • Run payloads designed to inject malware or steal credentials from third-party sites.
  • Reverse-engineer the scanner payload configurations or access checks database without permission.

4. Pricing, Subscriptions, and Billing

Vergate offers flat-rate pricing based on usage limits. All prices are disclosed on our pricing page. Subscriptions are billed in advance on a recurring monthly or annual basis, depending on your billing selection. You may cancel your subscription at any time; however, no refunds will be provided for partial billing periods.

5. Account Termination and Policy Compliance

We reserve the right, in our sole discretion, to restrict, suspend, or terminate your access to the Service at any time, with or without notice, if we believe you are performing unauthorized security testing or violating any portion of these Terms. Upon termination, all active credentials, tokens, and access profiles associated with your organization will be immediately deactivated and purged.
